Welcome to Step Out Academy! These Terms of Use (“Terms”) govern your access to and use of our app, website, and related services (“Services”). By using our Services, you agree to comply with and be bound by these Terms. If you do not agree, please refrain from using our Services.
1. About Us
This App is operated by Step Out Academy Pty Ltd (ABN 22 667 517 231), a company incorporated in Queensland, Australia (“Step Out Academy”, “we”, “us” or “our”).
Our website is available at www.stepoutacademy.com.au.
You may contact us via the contact details published on our website.
Step Out Academy provides location-based educational walking tours delivered through a mobile application (the “App”).
2. Acceptance of Terms
By accessing or using the App, including by starting, joining or participating in a tour, you agree to be bound by these Terms of Use (“Terms”).
If you are using the Tour Guide interface or initiating a tour as an adult, you agree to these Terms:

on your own behalf; and
-
on behalf of any minor participating in the tour through a connected device.
A minor does not enter into a legally binding agreement with Step Out Academy. The adult initiating the tour accepts full responsibility for compliance with these Terms.
If you do not agree to these Terms, you must not use the App.
3. Eligibility and Supervision
You must be at least 18 years of age to initiate or control a tour using the App.
Children may participate in tours only under the supervision of a responsible adult.
The adult who initiates a tour:

is responsible for supervising all minors participating in the tour;

is responsible for all devices connected via a tour code;
-
is responsible for ensuring the App is used safely and in accordance with these Terms.
4. Nature of the App
The App provides location-based educational walking tours that may include:

GPS-enabled features;
-
augmented reality (AR) elements;
-
interactive or gamified components;
-
historical, cultural or environmental information;
-
content created by third-party organisations;
-
AI-assisted script generation tools.
The App is provided for informational and educational purposes only.
The App does not provide legal, medical, environmental, safety or professional advice.
5. Safety and Augmented Reality Disclaimer
Use of the App involves physical movement in real-world environments and may include augmented reality overlays.
You acknowledge and agree that:

You must remain aware of your surroundings at all times.

You must not use the App while crossing roads or in hazardous environments.

AR overlays may obscure real-world objects or hazards.
-
You must exercise caution in parks, beaches, heritage sites, roads and other public or private spaces.
-
You are responsible for assessing environmental conditions and risks.

Adult supervision of minors is required at all times.
Step Out Academy does not control physical locations used in connection with tours and is not responsible for the condition, safety, maintenance or management of any public or private location.
Use of the App is at your own risk.
6. Third-Party Locations and Content
Tours may take place in locations controlled by third parties, including but not limited to:

parks and beaches;
-
heritage sites;
-
council-managed areas;
-
tourism venues;
-
privately owned premises.
Step Out Academy does not control these locations and does not guarantee their safety, accessibility or suitability.
Some content within the App may be provided by councils, tourism organisations or other third parties. Such content reflects the views of the content provider.
To the extent permitted by law:

We do not independently verify all third-party materials;
-
We do not guarantee the completeness, accuracy or reliability of third-party content.
7. AI-Generated Content
The App may include optional AI tools that assist in generating draft scripts or educational materials.
You acknowledge that:

AI-generated content may contain errors, inaccuracies or omissions;
-
AI tools are provided for assistance only;
-
Content creators are responsible for reviewing, editing and approving AI-assisted content before publication.
Step Out Academy does not guarantee the accuracy, reliability or suitability of AI-generated material.
8. Intellectual Property
All intellectual property rights in the App, including but not limited to:
-
software and platform architecture;
-
characters and branding;
-
graphics and user interface design;
-
system structure;
-
educational framework and mechanics;
-
audio files and compiled scripts,
are owned by or licensed to Step Out Academy Pty Ltd.
You are granted a limited, non-exclusive, non-transferable, revocable licence to use the App for personal, non-commercial purposes only.
You must not:

reproduce, copy or redistribute App content;
-
reverse engineer or attempt to access source code;
-
extract scripts, data or system design;
-
commercially exploit any part of the App.
Third-party content remains the property of its respective owner.
9. Permitted Use
You must not:

misuse the App;
-
interfere with its operation;
-
attempt to access backend systems;
-
engage in conduct that may harm the App or other users;
-
use the App for unlawful purposes.
10. Data and Privacy
Your use of the App is subject to our Privacy Policy.
The App may collect:

location data during active use;

device information;
-
usage and behavioural metrics for improvement purposes.
We use third-party service providers including, but not limited to:

Firebase;
-
Google Analytics;
-
Amazon Web Services (AWS);

ElevenLabs (for script audio generation).
By using the App, you consent to the collection, processing and storage of data as described in our Privacy Policy.
11. Availability and Changes
We may:

modify, update or discontinue the App;

add, remove or change features;
-
modify or remove tours or content.
We do not guarantee uninterrupted or error-free access to the App.
12. Limitation of Liability
To the extent permitted by law:

We are not liable for indirect, incidental, special or consequential loss.

We are not liable for personal injury arising from misuse of the App or failure to supervise minors.

We are not liable for loss arising from third-party content or location conditions.

We are not liable for inaccuracies in AI-assisted or third-party materials.
Nothing in these Terms excludes, restricts or modifies rights or remedies available under the Australian Consumer Law or other applicable legislation that cannot lawfully be excluded.
Where liability cannot be excluded, it is limited to the extent permitted by law.
13. Indemnity
You agree to indemnify Step Out Academy against any claims, loss or damage arising from:

your breach of these Terms;

misuse of the App;
-
failure to supervise minors;
-
unlawful conduct in connection with the App.
14. Termination
We may restrict, suspend or block access to the App at any time without notice.
We may remove tours or content at our discretion.
Clauses relating to intellectual property, liability and indemnity survive termination.
15. Governing Law
These Terms are governed by the laws of Queensland, Australia.
Any disputes arising in connection with the App or these Terms are subject to the exclusive jurisdiction of the courts of Queensland.
